1.What SemFood is

SemFood is an entertainment app that simulates the experience of ordering food for delivery. No order placed in the app is real. No food is prepared, sold or delivered. No amount shown on an order is charged to you.

The restaurants, menus, prices, dish photos, couriers, ratings and delivery times shown in the app are entirely fictional and were created for the simulation. Any resemblance between a restaurant shown in the app and a real establishment is purely coincidental. No real establishment is registered, represented or affiliated with us in any way.

Geographic coordinates of commercial locations, as well as address and route data, may be obtained from public map databases to make the simulation realistic. This does not mean that a SemFood establishment, or any establishment, exists at the address shown.

2.Acceptance of these terms

By creating an account, accessing or using SemFood, you confirm that you have read, understood and fully agree to these Terms of Service and to the Privacy Policy. If you do not agree with any part of them, do not use the app.

In addition, for every simulated order, the app shows a notice that the purchase is simulated, that nothing will be charged and that nothing will be delivered, and asks for your confirmation. By confirming, you expressly acknowledge the simulated nature of that order.

3.Who may use SemFood

SemFood is intended for people aged 18 or over, or the age of legal majority in your country, whichever is higher. By using the app, you confirm that you have full legal capacity to accept these terms.

If you are between 13 and the age of majority in your country, you may only use the app with the permission and under the supervision of a parent or legal guardian, who is also bound by these terms. Children under 13 may not use the app.

Where the law sets a higher minimum age for consenting to the processing of personal data (for example, 16 in parts of the European Economic Area), that age applies: below it, use requires the permission of a parent or guardian.

You are responsible for keeping your account credentials confidential and for all activity carried out on your account.

4.No consumer relationship regarding orders

Since there is no sale, supply, preparation, transport or delivery of food, there is no consumer relationship between you and SemFood with respect to simulated orders. The amounts shown on an order are part of the simulation and do not constitute an offer, a commercial proposal, a promise of delivery or an obligation of any kind.

You have no right to demand delivery of a product, fulfillment of an order, reimbursement of a simulated amount or any compensation related to an order placed in the app.

5.Subscription, daily limit and payments

The app is free to use, with a daily limit of simulated "spending". We offer an optional paid subscription that raises that limit. The subscription gives access to an app feature: it does not buy food, does not buy delivery and does not generate credit of any kind.

Subscriptions purchased in the app are processed by the app store you downloaded SemFood from (Google Play or the App Store). Billing, automatic renewal, cancellation and any refunds follow the rules and policies of that store, and must be handled directly with it.

In Brazil, prepaid plans may also be purchased outside the app stores, with payment processed by Mercado Pago. These plans have a fixed term and do not renew automatically.

Under no circumstances do we receive, process or store your card or payment method details.

A subscription purchased through an app store renews automatically until you cancel it in the store settings. Canceling stops the next charge; it does not give a pro-rata refund for the period already paid, except where the store or applicable law requires it.

We may change subscription prices, the size of the daily limit, the available plans and the included features at any time. Price changes to active subscriptions will be communicated in advance through the store, in accordance with its rules.

6.Acceptable use

You agree not to use SemFood for any unlawful purpose and, in particular, not to: (a) present orders, receipts or screens from the app to others as if they were real transactions; (b) use the app to defraud, deceive or mislead anyone; (c) attempt to gain unauthorized access to systems, accounts or data; (d) systematically extract, copy or reproduce the app's content; (e) interfere with the service, overload it or circumvent technical limits, quotas or subscription controls; or (f) reverse engineer the app.

Any misuse of the app is your sole responsibility. In particular, we are not responsible for any consequence of you presenting content from the simulation to others as if it were real.

7.Intellectual property

SemFood, its brand, logo, visual identity, software, text, fictional catalogs and image treatment are owned by or licensed to us and are protected by applicable law. These terms do not transfer any rights in them to you, other than a personal, limited, revocable, non-exclusive and non-transferable license to use the app as set out here.

8.Service provided "as is"

To the maximum extent permitted by applicable law, SemFood is provided "as is" and "as available", without warranties of any kind, express or implied, including, without limitation, warranties of fitness for a particular purpose, uninterrupted operation, freedom from errors or defects, or accuracy of any information shown.

We do not guarantee that the service will be continuously available. We may suspend, limit, modify or discontinue it, in whole or in part, at any time, with or without prior notice.

The app relies on third-party services, such as app stores, infrastructure providers, map databases, routing and geocoding services, email services and artificial intelligence services. We are not liable for unavailability, errors, inaccuracies or interruptions caused by these third parties, including inaccuracies in maps, addresses, routes or positioning.

9.Limitation of liability

To the maximum extent permitted by applicable law, SemFood, its partners, directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, loss of data, loss of opportunity, reputational harm or non-economic damages, arising out of or related to the use of, or inability to use, the app.

To the maximum extent permitted by applicable law, our total aggregate liability, for any cause and on any legal basis, is limited to the greater of (a) the amount you actually paid for SemFood subscriptions in the 12 months before the event giving rise to the claim and (b) a nominal amount.

Since the service is a simulation and no goods are sold or delivered, we are not liable for defects in, or harm caused by, products or services related to food, deliveries or establishments, none of which exist.

You are solely responsible for the decisions you make and the actions you take based on any information shown in the app, including any trip made to an address shown in the simulation.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law. If any limitation set out here is held to be invalid, it will apply to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

10.Indemnification

You agree to indemnify and hold harmless SemFood, its partners, directors and employees from any claims, losses, damages, fines and expenses, including attorneys' fees, arising from: (a) your use of the app in breach of these terms; (b) your violation of any law or third-party right; or (c) your presenting content from the simulation to others as if it were real.

11.Suspension and termination

We may suspend or terminate your access, with or without prior notice, in the event of a breach of these terms, suspected fraud, abusive use of the service or a legal requirement. You may close your account at any time through the app or through the channel listed on the data deletion page.

Closing your account does not entitle you to a refund of a subscription already paid, except where the app store or applicable law requires it.

12.Changes to these terms

We may change these terms at any time. The current version is always the one published on this page, with the date of the last update shown at the top. Material changes will be announced in the app. Continuing to use SemFood after a new version is published means you accept it.

13.Governing law and jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil.

If you live outside Brazil, the choice of Brazilian law does not override the mandatory consumer protection and data protection rules of your country of residence, nor your right to go to the courts and authorities there where those rules guarantee it.

Disputes will be heard in the courts of the user's place of residence where the law requires or allows it; otherwise, in the courts of the district where SemFood is headquartered.
